Abstract

Social rape has become the main form of rape cases in China

and with the help of the Internet

it has a severe social impact. Its unique characteristics bring difficulties to the investigation and evidence collection

conviction

and sentencing. This paper starts with the current situation and characteristics of social rape cases and focuses on analyzing the dilemma of social rape cases

discussing the identification standard of the victim's will

and trying to put forward relevant suggestions and countermeasures to provide working ideas for solving the difficulties in filing

obtaining evidence and handling in practical work.
