With the development of new forms of employment
there is a serious violation of the legitimate rights and interests of workers in their employment
which fundamentally stems from the imbalance in labor-management distribution. Faced with new forms of employment
countries have made various efforts. In China
multiple departments have jointly issued the "Opinions" to protect the legitimate rights and interests of workers in new forms of employment such as online delivery riders
ride-hailing drivers
truck drivers
and internet marketers. It is recommended to change the traditional "binary" management model and establish specialized regulations for employment in new formats
actively facilitating their participation in labor unions
and leveraging the power of labor unions to safeguard their legitimate rights and interests. Additionally
companies should standardize their employment practices
bringing practitioners within the scope of labor law protection. Even in the presence of non-labor relationships
it should also break through the boundary of the equal subject of the traditional civil law and interests of practitioners as much as possible. Moreover
companies should establish a positive corporate culture centered around labor
actively foster harmonious labor relations
and achieve a balance in labor-management d
istribution.
