摘要

Abstract

The system of small claims is an important part of the reform of the separation of simple and complicated

and it bears the heavy responsibility of efficiently resolving disputes. The retrial can reflect the deficiencies of the parties in the practical operation of the small claims procedure. At present

there are few precedents in the academic circles to study the civil small claims procedure from the perspective of retrial. Through screening the retrial documents of small amount cases

we can find problems in the operation of small amount litigation procedures

and explore the improvement path of small amount litigation procedures without changing the legislation prohibiting appeals. That is

by strengthening the protection of the right to hearing claims and the limited application of the principle of equity in small claims proceedings

we can achieve a fair trial of small claims

and finally achieve the goal of simple and complicated diversion and rapid resolution of disputes.
