摘要

Abstract

This article deeply discusses the principle of proportionality

which is of great significance in the modern legal system and runs through the fields of constitutional and administrative law. The first chapter expounds its concept

basic connotation

legal basis and dual attributes in the constitution and administrative law. Then it constructs the proportional principle system under the cross-vision of Constitution and administrative law

covering the respective systems of constitution and administrative law and the integration of the two cross-fields. Then it analyzes its application and expansion in public governance

digital governance

national emergency and other situations. Finally

from the legislative

judicial and administrative levels

it puts forward the perfect path for the application of proportionality principle

aiming at providing theoretical support and practical guidance for standardizing the exercise of public power and protecting citizens' rights.
