and the Ministry of Justice jointly issued the Opinions on the Handling of Criminal Cases of Drunken Dangerous Driving

refining the identification of drunken dangerous driving crimes

and correcting the punishment of ignoring the actual harm results

which can effectively guide judicial practice

but the opinions did not take into account China's actual national conditions. And too vague handling rules for the judicial authorities to "create" space for discretion. Therefore

it is necessary to build a scientific drunk driving evaluation system based on the actual national conditions of China's fight against drunk driving

so as to achieve individual justice

reasonably limit the discretionary power of judicial organs

build a multidimensional social governance mechanism

and add the system of "first punishment without punishment" and "elimination of previous convictions" for drunk driving dangerous driving crimes

so as to improve the scientific path of the Chinese version of drunk driving dangerous driving crimes.
